The Hornsey Club Rules

1. The Club shall be called “The Hornsey Club”, which shall comprise the Hornsey Cricket Club and the Hornsey Lawn Tennis Club, members of any which Clubs shall be deemed to be members of the Hornsey Club. 
 
The colours of the club shall be Maroon, Silver-Grey and Blue. 
 
2. The objects of the club shall be the playing of Cricket and Lawn Tennis and such other sport or game as may be decided upon by a majority of the members. 
 
3. The Laws of Cricket and Lawn Tennis as laid down for the time being by the Marylebone Cricket Club and the Lawn Tennis Association (LTA) respectively shall be adopted by the Club. 
 
Hornsey Cricket Club holds Community Amateur Sports Club (CASC) status (registration number 00459), and adheres to CASC regulations accordingly.  In addition, Hornsey Club shall aim to: 
 
 foster and promote the sports of cricket and tennis at all levels within the community and within the sport, providing opportunities for recreation, coaching and competition.

 ensure that all members, playing and non-playing, abide by the ECB Code of Conduct which incorporates the Spirit of Cricket and by the Laws of Cricket and the LTA Code  of Conduct, Player Notices and Rules of Tennis

 ensure a duty of care to all members of the club by adopting and implementing the ECB „Safe Hands – Cricket‟s Policy for Safeguarding Children‟ and any future versions of the Policy; and Safeguarding Children in Tennis, the LTA Child Protection Policy  as well as the Club‟s own Safeguarding Policy Statement

 ensure a duty of care to all members of the club by adopting and implementing the ECB Cricket Equity Policy and the LTA Equality and Diversity Policy and any future versions of the Policies. 
 
4. All property belonging to the Club shall be vested in Trustees who shall be elected by the members, and of whom there shall be not less than two nor more than four at any one time.  The Trustees shall be Arthur Cornick, John Goodby and Dallman, who, or other Trustees for the time being, are hereinafter called “the Trustees”.  The Trustees shall hold office until death or resignation unless removed from office by a special resolution as hereinafter defined.  Any casual vacancy in the office of Trustee may be filled by the Committee, and the person so appointed shall hold office until the next General Meeting after such appointment, when he shall retire but may be re-appointed by the members at such meeting. 
 
The Trustees shall deal with the property of the Club as directed by resolution of the Committee.  An extract from the Minute Book of the Committee, certified in writing by the Chairman of the Meeting at which a resolution to authorise any such dealing was passed, and by the Honorary Secretary and Honorary Treasurer of the Club for the time being as a correct copy of the entry in the Minute Book shall be conclusive evidence for all purposes that the consent and authority of the Committee to such dealing has been obtained. 
 
5. The entire management of the Club, except as otherwise provided by these Rules, shall be deputed to a Committee (hereinafter called “The Committee”) composed of the President, the Chairman, an Honorary Secretary, and an Honorary Treasurer (hereinafter called “The Officers of the Club” and members appointed in accordance with Rules 9 and 10 hereof.  Four members of the Committee shall form a quorum. 
 
6. The Offices and Vice-Presidents of the Club shall be elected annually by ballot at the Annual General Meeting of the Club held in accordance with Rule 9 hereof, each member present in person and entitled to vote under the provisions of Rule 23 hereof having one vote. 
 
7. The Committee shall have power:- 
 
(a) to add to its number, but so that the number of its members (excluding the Offices of the Club) shall not exceed fifteen at any one time; 
 
(b) to fill casual vacancies; (c) to appoint and/or dissolve Sub-Committees other than those elected at the Annual General Meeting in accordance with Rule 10 hereof; 
 
(d) to remove from the list of members of the Club the name of any member whose subscription shall remain unpaid at the close of the period covered by such subscription; 
 
(e) to suspend from time to time the Entrance Fees payable by new members; 
 
(f) to vary the Entrance Fees and/or the Annual Subscriptions and to create new classes of membership, but so that no such Entrance Fees or Annual Subscriptions shall be changed by more than 25 per cent from the figures at which they stand.    No Suspension or variation under Sections (e) or (f) of this Rule shall take effect until the commencement of the period for which the Entrance Fees or Annual Subscriptions so suspended or varied shall be payable.  Any such suspension or variation shall be subject to the approval of the members present and entitled to vote at the next General Meeting of the Club. 
 
(g) The Committee shall if necessary be empowered to borrow money on behalf of the Club. 
 
8. No Sub-Committee shall have power (a) without the authority of the Committee to authorise the expenditure of any money; or (b) to decide any question affecting the rights or privileges of members generally or of different classes of members. 
 
9. The Annual General Meeting of the Club shall be held each year for the purpose of electing the President, Chairman, Vice-Presidents and Offices of the Club, and of electing the SubCommittees of the Hornsey Cricket Club and Hornsey Lawn Tennis Club.  This Annual General Meeting shall also receive the audited statement of Accounts for the preceding year and transact any other business which may be brought before it. 
 
10. At the Annual General Meeting the Sub-Committees of the Hornsey Cricket Club and Hornsey Lawn Tennis Club shall be elected by ballot, only those members who shall have for the past season paid subscriptions as playing members of their respective Clubs being eligible to propose, second and vote in their respective ballots.  No Member may be proposed for election in more than one category in each of the Hornsey Cricket Club and Hornsey Lawn Tennis Club.  A list shall be posted in the Club Pavilion at least two weeks before the date of the Annual General Meeting for the purpose of receiving nominations of members for election as Officers and VicePresidents of the Club, Officers of the Sub-Committees (Honorary Secretaries and Captains) and members of the Sub-Committees and a representative of the Honorary Members, together with the names of their proposers and seconders.  This list shall be removed the day before the date of the Annual General Meeting. 
 
The constitution of the Sub-Committees shall be as follows:- 
 
(1) Hornsey Cricket Club:  Captain, Honorary Secretary and three other playing members. (2) Hornsey Lawn Tennis Club:  Captain, Honorary Secretary and three other playing members. 
 
Each Sub-Committee shall have power to add to its number, but so that the number of its members including its Officers but excluding ex-officio members shall not at any time exceed eight.  The Officers of the Club shall be ex-officio members of all Sub-Committees.  Three members of a Sub-Committee shall form a quorum. 
 
Each Sub-Committee when duly elected shall meet forthwith and appoint one of its members to be a member of the Committee in addition to the Officers of the said Sub-Committee.  The representative of the Honorary Members shall also be appointed to be a member of the Committee. 
 
11. Subject always to the approval and sanction of the Committee and to the provisions of Rules 3 and 8 hereof, the Sub-Committees shall have complete executive power and responsibility in the control of the organisation and play of their respective Clubs, including the arrangement of matches an the appointment of Captains, other than those elected at the Annual General Meeting, and Team Selection Committees. 
 
12. The Ground and Pavilion shall be open on every day throughout the year at the discretion of the Committee and subject always to the terms and conditions for the time being imposed on the Trustees by the Ecclesiastical Commissioners of England. 
 
If any question arises as to the fitness of the ground for the playing either of Cricket or Lawn Tennis it shall be decided by the members or members present of the Sub-Committee concerned in consultation with the Groundsman, in whose hands the decision shall rest if not such members are present. 
 
13. Club subscriptions will be set on a non discriminatory and fair basis.  The club will keep subscriptions at levels that will not pose a significant obstacle to people participating.   
 
All subscriptions shall be due and payable May 1st.  Subscriptions and Entrance Fees (if any) from New Members and Vacation Members shall be due and payable immediately on election. 
 
New members joining the Club during the course of a year shall be allowed a reduction of 1/12 of the appropriate subscription for each fully expired month of the relevant subscription year. 
 
Any member whose subscription remains unpaid for thirty-one days after the same shall have become due and payable as aforesaid, shall receive notice in writing from the Honorary Treasurer, and if the subscription remains unpaid for seven days from the date on which such notice shall have been given, the name of the defaulting member may, if the Committee so decide, be posted in the Pavilion, and in such event he or she shall not be allowed to use the Club ground or premises until his or her subscription shall have been duly paid. 
 
Those unable to pay the full amount may be subsidised by the club on application to the committee. If the application is successful, they will be asked to contribute voluntary work as designated by the committee or its representative. This work will be computed by the rate the club pays bar staff or non specialised ground staff multiplied by the number of hours needed to reach the equivalent of the sub in question (e.g. full, unemployed or junior). 
 
14.  Any person may apply to become a member of the Club by completing the Club‟s application form.  The Committee shall have power to elect without notice as temporary Honorary Members ant Members of a team visiting the Club for the day of the Match. 
 
15.  Membership of the club shall be open to anyone interested in the sport of cricket or tennis on application, regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs.  However, limitation of membership according to available facilities is allowable on a non discriminatory basis. 
 
All members are encouraged to participate fully in the activities of the club. 
 
16.  A copy of these Rules shall be made available to each member on his or her election, and he or she shall be bound thereby.  A copy of the Rules will be made available for viewing either in the Pavilion or by contacting the Honorary Secretary. 
 
All cricket members shall also be bound to the Club‟s Code of Conduct for Cricket Club Members and Guests. Junior cricket members shall also be bound by the regulations included in the Hornsey Colts welcome booklet. 
 
All tennis members shall be bound by the LTA‟s Code of Conduct and Player Notices.   
 
Any parent, carer or guardian of a junior member shall have automatic non-voting membership status of the club as part of that junior membership. 
 
17.  A new member shall not exercise any of the rights and privileges of membership before his or her Entrance Fee, if any, and Subscription shall have been paid. 
 
18.  Any member of the Club who intends to resign his or her membership shall give notice in writing to the Honorary Secretary before the date fixed for the payment of his or her subscription under Rule 13.  If such notice be not given before the stipulated date, the member shall remain liable for the payment of his or her subscription for the current season. 
 
19.  Any member shall, on ceasing to be a member, forfeit all right and interest in the property of the Club. 
 
20.  All complaints regarding the behaviour of members should be lodged in writing with the Secretary.

 The Committee shall appoint a Disciplinary sub-committee who will meet to hear complaints within 21 days of a complaint being lodged.  Any member requested to attend a Disciplinary sub-committee shall be entitled to be accompanied by a friend or other representative and to call witnesses.  The Committee (or its sub-committee) has the power to take appropriate disciplinary action, including the termination of membership. 
 
The outcome of the disciplinary hearing shall be put in writing to the person who lodged the complaint and the member against whom the complaint was made within 14 days following the hearing. 
 
There shall be a right of appeal to the Committee against either the finding or the sanction imposed or both following disciplinary action being taken.  The Committee shall appoint an Appeals Committee (a maximum of three) which shall not include members involved with the initial disciplinary hearing but may include non members of the club.  The Appeals Committee shall consider the appeal within 21 days of the Secretary receiving the appeal.  The individual submitting the appeal shall be entitled to be accompanied by a friend or other representative and to call witnesses.  The decision of the Appeals Committee shall be final and binding on all parties. 
 
21.  An Extraordinary General Meeting, for the consideration only of the business specified in the notice convening it, shall be convened by the Honorary Secretary at any time, either on the instructions of the Committee or at the request in writing of any ten members of the Club. 
 
22.  Seven days‟ clear notice in writing of every General Meeting shall be given to every member of the Club. 
 
23.  The persons entitled to vote at any General Meeting of the Club shall be adult members whose subscriptions are fully paid up at the time of the meeting, and except as otherwise provided by these Rules, all matters discussed at any such meeting of the Club shall be decided by a majority of such members present and voting.  A member shall have only one vote notwithstanding that he or she may be a member of more than one of the Sections. 
 
24.  At any General Meeting of the Club twenty five members entitled to vote shall form a quorum. 
 
25.  These Rules may be altered and other rules may be added by Special Resolution. 
 
26.  A resolution shall be a Special Resolution when it been passed by not less than threefourths of such members entitled to vote as are present in person at a General Meeting of which notice specifying the intention to propose such resolution as a Special Resolution has been given. 
 
At any Meeting a declaration by the Chairman that a resolution have been carried or lost, as the case may be, shall, unless a ballot is demanded by three members present and entitled to vote, be conclusive evidence of the fact without proof of the number or proportion of the votes recorded in favour of or against the resolution. 
 
27.  Any notice require by these Rules to be given to any member may be given to such member either personally or by sending it to him or her by post in a prepaid envelope or on a prepaid postcard to the place of abode last notified by him or her to the Honorary Secretary, and service of such notice so sent by post shall be deemed to have been properly effected at the time at which it would have been delivered in the ordinary course of post, notwithstanding any delay or loss in transmission.  The non-receipt of a notice from any cause whatsoever by any one or more members shall in no way invalidate the proceedings at any General Meeting of the Club. 
 
28.  The Club shall not be dissolved without the consent of three-fourths of those members who shall have paid their subscriptions for the year in which the proposal for dissolution is made. 
 
29.  If at any time it is decided to dissolve the Club: any surplus assets thereof shall be applied for approved sporting or charitable purposes only: and any deficit in the funds thereof shall be borne by all members entitled to vote under the preceding Rule in equal shares. 
 
30.  Except for donations by the Club to charities or to other clubs that are registered as Community Amateur Sports Clubs, any surplus income or gains realised by the Club shall be reinvested in the Club. 
 
31.  The Trustees, the Officers of the Club and members of the Committee for the time being shall be at all times kept harmless and indemnified by all members of the Club against any liability arising out of any act properly done by them on behalf of the Club.
